The Federal and Washington State Laws of the United States of America (USA) banned sexual harassment and considered it a crime. Additionally, sexual harassment is a kind of sexual discrimination and considered violation of the relevant civil laws.
Sexual harassment is everywhere in the world and USA is not exceptional in this cases, it is practiced at work, house, university and markets.
Individuals who meet each other several times or have a kind of relationship are involved.
The relationship could of different nature such as neighbors, teacher, student, employee or employer
Sexual harassment is defined as touching, speaking, joking or telephonic or e-mail conversation with another person against her of his will.
This relationship could be direct or indirect and in case of unwillingness it is called sexual harassment.
For example if someone touches another person or demand sexual relationship against her or his will it is called direct sexual harassment, but if one person sent another person naked photos it is called indirect sexual harassment.
Sexual harassment usually leads to rape; therefore, we should be careful and inform our children and family members about sexual harassment.
Most victims of sexual harassment are women and children; Victims of sexual harassment and rape may suffer from various mental and physical illnesses and may suffer from them for a long time.
Two types of sexual harassment happened at schools, universities and at work place, the first type is the creation of Hostile Environment created around the victim and the second type is direct harassment which is called Quid Pro Quo in which the victim is demanded active sexual relationship.
In the first type of sexual harassment, the harassed person is sexually harassed by the harasser’s words, gestures and physical contact; the victim may be a student or an employee, and the harasser may be another student, another employee, an administrative employee, a supervisor, a teacher, or another competent person.
In such an environment If the person being harassed through the use of sexual jokes, sexual stories, conversations and questions about personal and sexual life, sexual jokes in normal and official conversations, talks about the person’s beauty, clothes and body parts, expressing views about the persons’ body part of inviting him or her by force to have sexual relations in the absence of consent, this is sexual harassment and in this case the harassed person felt the victim of sexual harassment at work and in the educational environment.
Sometimes looking at someone repeatedly and instinctively, staring at certain parts of someone’s body, eyeballing and touching without consent are also considered sexual harassment.
The second type of sexual harassment is the one in which one person openly demand from another sexual relationship against performing a service or a task.
For instance, a teacher demand from his student sexual relationship against good marks or at work an employer demand from his employ sexual relationship against hiring, promotion, increment, leave approval or any other incentive.
Sexual harassment does not have to be sexual in nature, but could include offensive comments about a person’s gender, for or example, it is illegal to harass a woman in general with offensive comments.
Sexual harassment at work is of two type, direct sexual harassment is the one in which women are promised, promotion, admiration, increment against sexual favour or she is threaten to compliance with the demand of employer otherwise she would be fired from the work.
In indirect work place harassment, the workplace is occupied with sexually driven behaviors and talks that caused harassment, insecurity and harassment working women, especially women who work in small offices, face sexual harassment more than others.
Also, sexual harassment is more common at private institutions than in government institutions, because there is no strict monitoring.
Work insecurity is relatively high at private institutions and women are in a weak position in private or non-governmental institutions where the number of employees is small and the clients are few, the conditions for sexual harassment are equal. Sexual harassment is also more likely in some jobs or professions, such as jobs that have a lot of customers or clients.
Both men and women can be victims of sexual harassment, or both parties may be of the same sex, but most of the victims are women and almost all of the harassers are men. Also, everyone can face different types of sexual harassment at any age.
Embarrassment, shame, disappointment, threat feeling, family problems and most importantly fear from “blame and guilt” are the biggest reasons for women’s silence in the wake of sexual harassment. .
Women do not have much faith in judicial institutions because they believe that if they complain and report a crime, no one cares about them and they will be blamed, threatened, insulted and humiliated.
How to protect yourself, family from sexual harassment?
1-Whenever we are faced with the above mentioned harassment incidents we should strongly reject and say no, if saying no did not work then we need to react and it could be becoming angry, leaving the place, making noise or screaming. Doing so is the right of victim.
2-If we face sexual harassment at school then we should inform our teacher, school director, college or university head, If we are at work we have to inform out head, supervisor, manager or head of the Human Resource Department.
3-If we face sexual harassment at bazaar or public places it is important that we should leave that area and take our selves to a safe place, we need to keep in mind the specifications of perpetrator and call police, we need to chase the perpetrator where he lives and work.
4-Children should be instructed in this regard and should be told to share all those things with parents about which they feel insecure outside, there is need to take you children in confidence so they could share everything with parents.
Sexual harassment punishment in US
This is harsh punishment for any kind of harassment in the US, according to the US criminal law the punishment of sexual harassment is life imprisonment besides cash fine. People involved in children harassment are punished life imprisonment.
